Welcome to the products of Destination Tours LLC: the Destination Tours app, the Destination Hunts app (together, the "Apps"), and destinationtours.com (the "Website"). These Terms of Service ("Terms") govern your access to and use of our services, including our mobile applications, website, content, and features (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use our Services. By using the Services, you represent that you meet this requirement. Destination Hunts participants under 13 may only take part in an organized event with the consent and supervision of the event organizer and a parent or guardian.
2. Description of the Services
Destination Tours provides:
- Self-guided tours and attraction information
- Multilingual content
- Hotel information including amenities, hours, and contact details
- Optional promotional offers from participating hotels
- Maps, GPS-based features, and location-based content
Destination Hunts provides:
- Team-based scavenger-hunt events organized by an event host
- Photo, video, trivia, and location-based (GPS) challenges
- Live leaderboards, activity feeds, and team chat
- Joining a team using a code provided by your event host
Features may change or be updated at any time.
3. User Responsibilities
You agree to:
- Use the Services only for lawful purposes
- Not interfere with, disrupt, or attempt to gain unauthorized access to the Services
- Respect all intellectual property rights associated with our content
4. Accounts & Event Participation
If your hotel or organization creates an account:
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activity that occurs under your account
Destination Hunts players join a team with a display name and an event code instead of creating an account. You are responsible for the activity that occurs under your team session on your device, and you agree to choose a display name that is not offensive, misleading, or infringing.
Destination Hunts events are created and run by an event organizer (for example, your employer or event host). The organizer controls the event's content, teams, and schedule, and can see participant activity, including challenge submissions and help-channel messages. Your participation in an event may also be subject to the organizer's own rules.
We reserve the right to suspend or terminate accounts or event sessions for violations.
5. User-Generated Content
Destination Hunts lets you submit content, including photos, videos, challenge answers, chat messages, display names, and team images ("User Content").
- You retain ownership of your User Content.
- You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process your User Content as needed to operate the Services — for example, showing submissions to your team and event organizer, scoring challenges (including automated review), and displaying leaderboards and activity feeds.
- You represent that you have the necessary rights to the User Content you submit, including permission from people who appear in your photos and videos.
- You must not submit User Content that is unlawful, harassing, hateful, sexually explicit, violent, infringing, or that invades another person's privacy.
- We and event organizers may remove or reject User Content that violates these Terms, and may suspend participants who submit it.
6. Location Services
Some features rely on device location data — including maps, distance calculations, and Destination Hunts GPS challenges. You may enable or disable location services at any time in your device settings, but certain features may not function without it.
7. Safety & Event Conduct
Scavenger hunts and self-guided tours take place in the physical world. You agree to:
- Stay aware of your surroundings and follow all laws, signage, and property rules
- Never use the Apps while driving or in situations requiring your attention
- Not trespass, take unreasonable risks, or endanger yourself or others to complete a challenge or reach a location
You participate in events and tours at your own risk.
8. Hotel, Organizer & Third-Party Content
Hotels, event organizers, and partners may upload or provide:
- Offers
- Attraction recommendations
- Contact or amenity information
- Event and challenge content
We do not guarantee the accuracy, reliability, or availability of third-party content.
You agree that we are not responsible for hotel-provided information, organizer-provided event content, other participants' User Content, or external links.
9. Intellectual Property
All content, trademarks, logos, text, images, and software are owned by or licensed to us, except User Content, which remains yours (see Section 5).
You may not copy, reproduce, distribute, or create derivative works without our permission.
10. Prohibited Uses
You agree not to:
- Reverse engineer or attempt to extract source code
- Scrape or collect data from the Services
- Use the Services for commercial purposes without authorization
- Submit harmful or malicious content
- Cheat, tamper with scoring, or falsify your location in an event
- Impersonate another person or join a team you were not invited to
11. Disclaimers
The Services are provided "as is" without warranties of any kind.
We do not guarantee:
- Accuracy of data
- Availability of the Services
- Safety or suitability of recommended attractions, areas, or event locations
You assume all risks associated with exploring physical locations.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for:
- Personal injury
- Property damage
- Lost profits
- Data loss
- Service interruptions
- Actions or omissions by hotels, event organizers, participants, or third parties
13. Termination
We may suspend or terminate access at any time for any reason, including violation of these Terms.
14. Governing Law
These Terms are governed by the laws of the state or jurisdiction in which your company operates, without regard to conflict-of-law principles.
15. Changes to the Terms
We may update these Terms periodically. Continued use of the Services after updates constitutes acceptance of the revised Terms.
